DATA PROTECTION POLICY AND DISCLAIMER

I. Introduction

This policy for the processing and protection of personal data has been prepared in accordance with the provisions of Regulation (EU) 2016/679 of 27.04.2016 (hereinafter referred to for brevity “Regulation”) and the internal legislation applicable in the Republic of Bulgaria for the protection of personal data. The rules outlined in the document follow the principles of legality, good faith, transparency, accuracy and minimization of collected and processed data.

Upon acquainting yourself with this policy, you will learn about what personal data are processed by Dilyan Kolev, attorney-at-law, when using the website – dk-law.bg, as well as in the process of exercising his powers under the Law of Advocacy. You will find out about the purposes and the legal grounds for collecting your data and what the maximum period of data storage is, as well as what your rights are in relation to stored personal data and how to exercise them.

II. Legal Definitions

Personal data” is any information by which a person can be directly or indirectly identified, including but not limited to: names, identification number, date and place of birth, nationality, contact details (permanent or current address; phone number; email address) etc.

“Processing of personal data” is any individual action or set of actions, carried out in relation to personal data, such as: collection, recording, storage, disclosure through transmission distribution, deletion, or destruction.

“Administrator of personal data” is any individual, legal entity, agency or other structure which alone or jointly with others determines the objectives and means of personal data processing.

III. Information About the Administrator of Personal Data

Dilyan Kolev is an individual practicing as licensed attorney-at-law within the meaning of The Law of Advocacy. He is a member of the Sofia Bar Association (SAB). His personal attorney ID number is 1900744210. He is registered in the BULSTAT Register as an individual exercising free profession within the meaning of the law.

IV. Purposes and Legal Grounds for the Processing of Personal Data

1. Purposes of Processing Personal Data

1.1. Usage of our website

First and foremost, your personal data is being processed when using the website dk-law.bg and more specifically, the special form for inquiries “Need assistance?”. The latter collects the following personal data: name and surname; e-mail address; telephone number (at your discretion). This is the necessary minimum of personal data needed in order to respond to your inquiry.

We keep the personal provided in strict confidence, as it is being used exclusively for the above-mentioned purpose – communicating with you about the case you had requested.

Our website uses “cookies” – please refer to Section VII below.

1.2. Provision of Legal Assistance

The processing of your personal data is necessary for the purpose of providing the legal services requested by you – preparation of contracts, legal statements and other legal papers, providing legal consultations, carrying out administrative procedures, implementation of legal representation and defense in court cases, etc.

Personal data under this point may include, but is not limited to: names, personal identifying number/personal foreign ID number, date and place of birth, nationality, identity document type and number, permanent/current address, ZIP code, mobile/stationary phone number, personal/ work email address, etc. Depending on the nature of the case, it may require the processing of similar personal data of the individuals on the opposing party on your case.

Personal data collected is kept strictly confidential and used only to exercise the powers of the Atty/ Dilyan Kolev under the Law on Advocacy, the Law on Legal Assistance and the applicable legal acts related to the provision of legal advice and assistance.

2. Legal Grounds for Processing Personal Data

Your personal data are collected and processed in accordance with Regulation (EU) 2016/679 of 27.04.2016:

2.1. Common Hypotheses

A) To execute contracts to which the data belongs to a party, or for taking action at the request of a party before completing a contract – art. 6, point 1, letter “b” of the Regulation;

B) In fulfillment of the legal obligations of Atty. Dilyan Kolev under the Law of Advocacy, The Law on Legal Assistance, the Lawyer’s Code of Ethics and other statutory and by-law regulations – art. 6, point 1, letter “c” of the Regulation.

2.2. Exception

Apart from the hypotheses under Point 2.1., letters A) and B), your personal data can be collected and subsequently processed only after your explicit written consent – art. 6, point 1, letter “a” of the Regulation.

V. Disclosing Personal Data to Third Parties

1. General Rule

Attorney Dilyan Kolev undertakes strong technical and organizational measures to protect your personal data from theft, misuse and/or unauthorized access by any third parties.

2. Exceptions

Disclosure of your personal data to third parties, without your consent, is allowed under the following circumstances:

2.1. in cases where this is expressly provided for in a law or other regulatory act;

2.2. when there is a legal request / subpoena of a court and/or pre-trial proceedings authorities (police, investigation, prosecution);

2.3. to perform accompanying activities / services in accordance with the interests of the data owner of the specific case:

A) before state bodies and institutions charged with public functions, within the framework of their powers (NRA; NSSI, etc.);

B) before banks for the purpose of making payments;

C) to courier companies and/or postal operators in order to correspond with the owners of the personal data.

3. Publicly Available Data

The disclosure of personal data to third parties should not be considered unlawful when the relevant data appear in a public register and are generally available.

4. Personal Data Owner Consent

In all other cases, disclosure of personal data to third parties can only be done with the prior written consent of the data owner.

VI. Period of Storage of Personal Data

In his capacity as a personal data administrator, Atty. Dilyan Kolev stores your personal data for a period of a minimum duration, in accordance with the purposes of processing and terms provided for in the law.

According to the provisions of the Law of Advocacy, Atty. Dilyan Kolev is obliged to store the paperwork for cases in which he was a plaintiff or defendant for a period of 5 years upon completion.

VIII. Your Rights

As the owner of the relevant personal data, you have the right at any time:

A) to request confirmation and/or detailed information about what personal data has been stored for you, including a copy of such;

B) to request correction (update) of your personal data;

C) to request that your personal data be deleted (when there is no legal basis for continuing the processing or such has been discontinued);

D) to request restriction of processing (including requesting the administrator to processes your data for precisely defined purposes when it cannot be deleted due to the presence of a legal obligation);

E) to object to the collection and further processing of your personal data.
