Global warming and environmental pollution are becoming a topic of growing concern and heated discussion as of late. Over the past decade, the generation and distribution of energy from renewable sources (sun, water, wind) have been established as a key tool for reducing emissions of carbon dioxide and slowing the progression of harmful climate change. Similarly to many developed countries in the world, interest in starting and developing “green” initiatives in Bulgaria is thriving. An increasing number of investors are interested in supporting clean energy efforts and the country has put in place various mechanisms to benefit those who take that route.
Proper planning, design, construction, and implementation of clean energy projects is a lengthy, multi-faceted and complex process, which is almost impossible to navigate without the assistance of an experienced energy law attorney.
The implementation of many business plans in Bulgaria requires prior performance of an environmental procedures such as – Environmental Impact Assessment (EIA) and/or Compliance Assessment (CA). These procedures are associated with numerous regulatory features, depending on the type of investment intention, therefore it is advisable to consult an attorney with expertise in the sphere of environmental law, in order to eliminate the risk of subsequent complications and troubles.
– provision of preliminary consultations and preparation of legal statements in connection with upcoming implementation of photovoltaic power plants (PVPPs) – analysis of ownership and regulation status of appropriate land plots, review of current regulatory requirements and specifics in the construction of PVPPs, approval of detailed development plans, approval of construction sites and changing the purpose of agricultural lands in connection with the construction of a PVPPs, etc.
– representation and assistance before the competent authorities, ESO and electricity distribution companies in connection with the construction, commissioning and connection of photovoltaic power plants to electricity grids;
– provision of preliminary consultations and preparation of legal statement in connection with upcoming implementation of hydroelectric power plants (HPPs) – permits under the Waters Act; analysis of applicable measures/restrictions provided for in the actual river basin management plans (RBMP), etc.;
– representation and assistance before the competent authorities, ESO and electricity distribution companies in connection with the construction, commissioning and connection of hydroelectric power plants to electric grids.
– provision of full assistance in procedures for connecting objects of residential and non-residential customers to the electricity distribution / transmission network – including review and analysis of received opinions containing the conditions for access to the electric grid, drafts of preliminary and final contracts for access to the electric grid in case of construction of a new object and/or expanding / increasing capacities of existing objects;
– provision of consultations, preparation of legal statements and assuring full assistance in procedures for purchasing private substations from electricity distribution companies.
– provision of consultations, opinions and assistance in procedures for EIA and/or CA of various types of investment intentions;
– analysis regarding the validity of issued decisions / opinions to assess the need for EIA/CA;
– provision of consultations and legal statements regarding the need for additional notification before the competent authorities in case of upcoming changes / extensions investment intentions that have been already coordinated with the environmental authorities;
– analysis of the legality of procedures for determining protected areas under Natura 2000, etc.
