In this regard, if you have decided to purchase a parking space, it is a good idea to acquaint yourself with some of the <strong>main legal issues in advance<\/strong>. <\/p>\n<p style=\"color: #9d1d20;\"><strong>What is the status of parking spaces according to the law?<\/strong><\/p>\n<p style=\"text-align: justify;\">According to the law, individual parking spaces <strong>do not have autonomous status<\/strong>. \u0422\u0435 \u043d\u0435 \u0441\u0430 \u043e\u0431\u043e\u0441\u043e\u0431\u0435\u043d\u0438 \u043a\u0430\u0442\u043e \u0441\u0430\u043c\u043e\u0441\u0442\u043e\u044f\u0442\u0435\u043b\u043d\u0438 \u043e\u0431\u0435\u043a\u0442\u0438 \u0432 \u043a\u0430\u0434\u0430\u0441\u0442\u044a\u0440\u0430. \u041f\u0430\u0440\u043a\u043e\u043c\u0435\u0441\u0442\u0430\u0442\u0430 \u0441\u0435 \u043f\u0440\u0438\u0435\u043c\u0430\u0442 \u0437\u0430 <strong>\u043f\u0440\u0438\u043d\u0430\u0434\u043b\u0435\u0436\u043d\u043e\u0441\u0442<\/strong> \u043a\u044a\u043c \u0441\u0430\u043c\u043e\u0441\u0442\u043e\u044f\u0442\u0435\u043b\u043d\u0438\u0442\u0435 \u043e\u0431\u0435\u043a\u0442\u0438 \u0432 \u0441\u0433\u0440\u0430\u0434\u0430\u0442\u0430 (\u0430\u043f\u0430\u0440\u0442\u0430\u043c\u0435\u043d\u0442\u0438, \u0430\u0442\u0435\u043b\u0438\u0435\u0442\u0430, \u043e\u0444\u0438\u0441\u0438). <\/p>\n<p style=\"text-align: justify;\">In general, parking spaces represent <strong>parts<\/strong> <u>of a land plot<\/u> <strong>or <\/strong><u>parts of a garage\/parking floor in a building<\/u> according to its architectural projects.<\/p>\n<p style=\"text-align: justify;\"><u><strong>IMPORTANT!<\/strong><\/u> Although <strong>according to the architectural projects<\/strong> the parking spaces are individualized as real parts, due to the lack of separate status, it is advisable that the co-owners of the respective land plot\/garage\/parking floor in a building sign between themselves a <a title=\"DISTRIBUTION OF THE USAGE OF A REAL ESTATE\" href=\"https:\/\/dk-law.bg\/en\/distribution-of-the-usage-of-a-real-estate\/\"><strong><span style=\"text-decoration: underline;\">contract for distribution of usage<\/span><\/strong><\/a>, whereby they mutually agree and approve the use of the parking spaces designed in the respective land plot\/garage\/parking floor in a building only by the persons who have the legal (and documentary) right to use them (owners, users).<\/p>\n<p style=\"color: #9d1d20;\"><strong>What is the difference between a parking space and a garage?<\/strong><\/p>\n<p style=\"text-align: justify;\">Unlike parking spaces, garages are <strong>separate objects<\/strong>. Garages have an autonomous status and separate identifiers in the cadaster. They are characterized by <strong>architectural and structural separateness<\/strong> (they have enclosing walls and separate individual access).  <\/p>\n<p style=\"text-align: justify;\">Garages <strong>are not subject to the restrictions<\/strong> applicable to parking spaces, which will be described below in the article.<\/p>\n<p style=\"color: #9d1d20;\"><strong>What types of parking spaces exist?<\/strong><\/p>\n<p style=\"text-align: justify;\">There are <strong>two main types<\/strong> of parking spaces:<\/p>\n<p style=\"text-align: justify;\">&#8211; <strong>outdoor parking spaces<\/strong> located directly on the land plot;<\/p>\n<p style=\"text-align: justify;\">&#8211; <strong>covered parking spaces<\/strong> located inside the building.<\/p>\n<p style=\"color: #9d1d20;\"><strong>Do I owe local taxes and fees after acquiring a parking space?<\/strong><\/p>\n<p style=\"text-align: justify;\">Although they do not have a separate status, being <strong>part of a land plot<\/strong> or <strong>part of garages\/parking floors in buildings<\/strong>, all parking spaces are subject to <strong>local tax and municipal household waste fee<\/strong>. For this reason, once you acquire a parking space (whether outdoor or covered one), it must be <strong>declared on your behalf<\/strong> before the competent municipal tax authority within the legally provided terms.<\/p>\n<p style=\"text-align: justify;\"><u><strong>IMPORTANT!<\/strong><\/u> If you do not declare the parking space you have acquired in the legally provided terms, a <strong>fine\/penalty<\/strong> can be imposed to you by the competent authorities.<\/p>\n<p style=\"color: #9d1d20;\"><strong>What are the restrictions on transferring the ownership of a parking space to a third party?<\/strong><\/p>\n<p style=\"text-align: justify;\">As the parking spaces do not have autonomous status and they are <strong>belongings<\/strong> to a separate object in a building (apartment, office, etc.), you should be aware that if you have purchased a parking space and <strong>decide to transfer it separately<\/strong> to a third party, this would (<strong>legally<\/strong>) be possible only if the counterparty of the transaction <strong>is also<\/strong> <strong>owner of a separate object in the same building<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The restriction applies <strong>regardless of the type of the property transaction<\/strong> \u2013 purchase-sale, donation, exchange, etc.<\/p>\n<p style=\"text-align: justify;\"><strong><u>IMPORTANT!<\/u><\/strong> This restriction <strong>does not apply<\/strong> if you transfer the parking space <strong>together with the separate object<\/strong> (apartment, studio, office) in the building. The sale\/donation\/exchange then can be made to a third party. <\/p>\n<p style=\"text-align: justify;\"><strong><u>IMPORTANT!<\/u><\/strong> You shall bear in mind that the above-mentioned restriction <strong>does not apply<\/strong> when it comes to the conclusion of a <strong>lease agreement<\/strong>.
